Divorces in Nevada
To obtain a divorce in Nevada, at least one spouse must live in the state for a minimum of six weeks and intend to make Nevada his/her home indefinitely.
Nevada is a “no-fault” state, which means you do not have to allege or prove any wrong doing to obtain a divorce. The most common ground asserted is “incompatibility.”
Divorces can be simple or they can be complex. Issues that arise during divorce include asset and debt division, child custody and child support, alimony/spousal support, asserting legal defenses to protect your rights, and returning to a former name.
If spouses agree on all issues and to save time, stress, and money, spouses can file together. If spouses can’t agree on everything and need the court to decide for them a Complaint must be filed and spouses will proceed with litigation in a contested divorce.
Legal Separation In Nevada
Nevada is community property state, which means that you and your spouse, with a few exceptions, are equally entitled to all assets and income obtained during marriage.
Likewise, spouses are equally responsible for all debt incurred during the marriage. You may not be ready for the finality of divorce, but need to take the next step and protect yourself while you figure out what to do.
A legal separation gives you the opportunity to take a break without putting your financial future in jeopardy.
